A : For Tourist, we hold 1 week, For Malaysian, 3-7 Days.

A : 24 Hours per day

 

Q : Did renter get gasoline or petrol ?

A : We just give nearly 20KM in range petrol. Renter need to fill the petrol themself. :)

 

Q : Did renter get driver & passenger insurance ?

A : Add on RM 50 / Per person to add insurance.

 

Q : Do i have to send the deposit or you may hold my credit card ?

A : No need, pay the deposit and rental once you arrive Malaysia.

 

Q : Do i need to pay full amount on the arrival ?

A : Yes.

 

TERM & CONDITION

 

 

1.0 MANAGE THE SERVICES (CLAUSE 1.1-1.16)

With this, we are ready to make this clause as term and conditionof Lafiy Marnia Travel & Tours Sdn Bhd if your company ready to use our services.

 

  1. IN CASE OF ACCIDENT

 If the vehicle is involved in an accident, is damaged, breaks down or requires repair or salvage, regardless of cause, the hirer shall notify the owner of the full circumstances by telephone immediately. Any towing or unwanted activities involve the car you should make a call first to hotline number 011-2558 2202.
The hirer shall not arrange or undertake any repairs or salvage without the owner's authority (this includes, but is not limited to, purchasing a replacement tyre) except to the extent that repairs or salvage are necessary to prevent further damage to the vehicle or to other property.
The vehicle claim insurance only covers for the vehicle, not the passenger. Passenger is advice to take their own insurance.

  1. IN CASE OF SUMMON

All penalties related to traffic and/or parking offences are the responsibility of the hirer and the owner may charge the hirer's credit card for any traffic and/or parking offence infringement fees incurred by the hirer. The owner undertakes, in the event that the owner receives notice of any traffic or parking offenses incurred by the hirer, to send a copy of any such notice to the hirer as soon as is practicable and to provide the necessary information to the relevant issuing authority for such notices to be directed to the hirer. The hirer has the right to challenge, complain about, query or object to the alleged offence to the issuing enforcement authority and has a right to seek a court hearing (within 56 days from the date of issue of the infringement notice or 28 days from the date of issue of the reminder notice).

  1. IN CASE OF MISSING

 All payment of monthly vehicle to the bank is fall under hirer to be settled to the bank while we make claim. Hirer must inform us if they want to make a police report. Usually claim process takes 6 month.

  1. IN CASE OF INVOLVE ILLEGAL ACTIVITIES

Hirer’s are not allowed to do any illegal activities involve in Malaysian law. We will give 100% commitment to the Malaysian Court and Police of Malaysia if you are subjected to criminal while using our car. All the Illegal activities are fall under hirer’s obligation. The hirer’s are prohibited to use the vehicles for any illegal purposed such as delivery drugs, weapons, and any subject matters that are prohibited in Malaysia.

  1. IN CASE OF LATE PAYMENT

 Hirer’s must be pay extended amount plus with penalty.

  1. IN CASE OF BREAK DOWN

 If the vehicle is involved in an accident, is damaged, breaks down or requires repair or salvage, regardless of cause, the hirer shall notify the owner of the full circumstances by telephone immediately.

24 Hour Roadside Assistance is free for all inherent mechanical faults (as determined by the owner or its authorized repairer) related to the vehicle specified in the Rental Document. For all other roadside assistance call outs including refueling, jump start, tyre related incidents, lost keys and keys locked in the vehicle, a service fee will be charged.
1If the vehicle requires repair or replacement, the decision to supply another vehicle to the hirer is at the owner's sole discretion.

  1. IN CASE OF EXTEND OF SERVICE

Hirer’s must inform to our marketing executives or officer at hotline 011-25582202 immediately.

  1. IN CASE OF COMPENSATION

Hirer’s must inform us in case to repair themselves (below RM100.00) before the car had being repaired. If not, you are not allowed to claim.

  1. PERSON WHO MAY DRIVE

 The vehicle may be driven during the full period of the hire only by the persons named in the schedule, and only if they hold a valid driver’s license which must be presented at time of pickup. (Note: all Driver’s Licenses must be in MALAY or have an authorized Malay translation, or hold an International Driving Permit, the country of origin Driver’s License must also be present upon pickup). Probationary or Restricted Licenses cannot be accepted.

1.10 PAYMENT BY HIRER

  1. The Hirer shall pay the Owner in full prior to dispatch (as payment for the hire of the vehicle for the agreed period) the sum specified in the schedule. The Hirer must have a Credit Card. The Hirer agrees to pay any additional costs in connection with the hire including (but not limited to) parking, toll road and speeding fines, damage to the vehicle, puncture repair and relocation and cleaning fees as incurred in connection with the Hirer’s possession of the vehicle, including those that become apparent following the termination of the hire. The Hirer authorizes the Owner to debit their Credit Card for the same.

  2. In addition to the payment specified in Clause 3.5 the Hirer shall pay to the Owner the sums specified in the schedule for insurance cover as set out in the agreement.

  3. The hirer shall pay for all petrol or diesel (but not oil) used in the vehicle during the period of the hire.

  4. The Hirer will be responsible for the entire cost of the hire should the voucher they present not be paid by the agent. The total payment will be charged to the Hirer’s credit card should payment from the agent not be received.

  5. The following credit cards will be accepted: Visa & Mastercard or cash.

1.11 HIRER’S OBLIGATION

  1. Smoking and/or animals are permitted in the vehicle at any time.

  2. The Hirer shall ensure that all responsible care is taken in handling and parking the vehicle and that it is left securely locked when not in use.

  3. It is the Hirer’s responsibility to be aware and in compliance with all Peninsular Malaysia Land Transport rules and regulations.

  4. Travelling with Children: The Child Restraint Law stipulates that children under 7 must be properly restrained in an approved child restraint. It is the Hirer’s responsibility to ensure the child restraint is installed correctly. It is strongly recommended by Land Transport of Malaysia that children should be seated in the rear of the car.

1.11 VEHICLE INSURANCES

  1. Third party cover is included in the quoted rate. The third party option covers the Hirer for all damage to a third party vehicle in the unlikely event of an accident.

  2. Third party cover does not cover tyre, windscreen/window damage, exterior body, underbody or single vehicle accidents.

1.12 ADDITIONAL HIRER COST

  1. After Hours dispatches are available on request only and may incur an additional charge (please contact the branch you are hiring from if you require further details).

  2. Any unpaid traffic or toll road infringements incurred during the hire period are transferred to hirer.

                                                                          

1.13 THE HIRER SHALL NOT:

  1. Sublet or hire the vehicle to any other person

  2. Permit the vehicle to be operated outside their authority

  3. Operate the vehicle, or permit it to be operated in any race, speed test, rally or contest

  4. Operate the vehicle in breach of the transport Act 1987. Operate the vehicle or permit it to be operated for the transport of more than the number of passengers or more than the weight of passengers, or more than the weight of goods specified in the certificate of loading for the vehicle.

  5. Drive or permit the vehicle to be driven by any other persons if at the time of their driving the vehicle the hirer or any other person is not the holder of a current driver’s license appropriate for the vehicle.

1.14 RETURN OF THE VEHICLE

The hirer shall at or before the expiry of the term of hire, deliver the vehicle to the branch detailed in the schedule, or obtain the owner’s consent to the continuation of the hire. (Note: No refund is available to the hirer if the vehicle is returned earlier than stated in the schedule). The vehicle is to be returned in a clean and tidy condition; if not, a RM100.00 cleaning fee may apply. The vehicle is shall to be returned with a full tank of fuel ; if it is not filled with fuel a RM 20.00 administration fee will apply in addition to the cost of the fuel. If not returned to the branch detailed, a relocation fee of RM 500.00 may be charged.

1.15 BREACH OF CONTRACT

The owner shall have the right to terminate the hire and take immediate possession of the vehicle if the hirer fails to comply with any terms and conditions of this agreement or if the vehicle is damaged. The termination of the hire under the authority of this clause shall be without prejudice to the other rights of the owner and the rights of the hirer under this agreement or otherwise.

1.16 RENTAL DURATION

 The term of hire shall commence and cease at the time and dates specified in the Schedule. (Note vehicle charges are on a 24 hour basis). First hour is free, after the first hour late a full day hire applies.

Rates, Amendments and Cancellation Conditions

  1. Rates and conditions quoted in our brochures and/or documentation are subject to change without notice. However (subject to changes in legislation or errors) the Owner will not alter rates or conditions applicable to the Hirer’s rental once the Hirer’s booking has been confirmed by the Owner unless a booking is amended.

  2. All amendments are subject to approval by the Owner. Rate recalculations are based on the rate at the time if reservation or the new rate at time of amendment (whichever is higher). In the instance where an extension is made while on hire with the Owner, the Owner will calculate the additional day’s charge at the applicable vehicle rate.

  3. Should the Hirer decide to voluntarily downgrade their vehicle type from the category booked, they will not be entitled to a refund.

  4. The Owner must authorize any rental extension beyond that specified in the Rental Agreement prior to the return of the vehicle. All extensions are subject to availability and must be requested through our reservations team at least 48 hours prior to drop off date on the original contract. The Owner reserves the right to charge a penalty fee of RM 100.00 in addition to the current daily rate per day of the unauthorized extension to anyone in breach of this.

  5. Cancellation policy: If the booking is cancelled on the day of the pickup or is a no show then 100% of the gross rental is charged.
